Terms of Service

Plain-language draft, pending legal review. These terms are written to be clear and to match what Booket actually does. They are not legal advice and have not yet been reviewed by an attorney. Items in [brackets] are decisions to be finalized with counsel before relying on this document.

1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you (“you,” the business or agency using Booket) and [Booket legal entity — to be set with counsel; the operating entity is based in Costa Rica with a U.S. (Texas) pilot] (“Booket,” “we,” “us”). By creating an account, requesting a free AI Visibility Report, or using the service, you agree to these Terms and to our Privacy Notice. If you do not agree, do not use Booket.

If you accept these Terms on behalf of a business, you represent that you are authorized to bind that business.

2. Definitions

Monitored Surfaces — the AI assistants Booket checks for your appearance: currently ChatGPT, Google Gemini, and Perplexity. This set may change as the AI landscape changes.

Show Up— your business is named or recommended in a Monitored Surface's response to a buyer-style search containing the specific primary service and area agreed in your dashboard (e.g., “men's haircut near South Congress”), in at least one Monitored Surface. Generic brand or unrelated category mentions do not count.

Activation Date — the date your subscription goes live and your profile is published (setup complete and approved). The 90-day Get-Found Guarantee clock starts here.

Exclusive Zone — the category-and-radius area in which, where exclusivity is offered, we agree not to onboard a directly competing business while your subscription is active and in good standing.

Third-Party Platforms— services outside Booket's control that your presence depends on or integrates with (e.g., OpenAI, Google, Perplexity, Google Business Profile, Square, your scheduler, review sites, payment and messaging providers).

3. Eligibility & accounts

You must be at least 18 and operate a legitimate business to use Booket. You are responsible for the accuracy of your account details, for safeguarding access to your account, and for all activity under it. Tell us promptly of any unauthorized use.

4. The service

Booket makes local service businesses machine-readable across AI assistants by structuring your business data, maintaining your agent profile and AI-readable surfaces, helping you grow the reviews AI weighs, monitoring your appearance, and — where you enable it — connecting your scheduler so an AI can hand off a booking.

Booket is a presence and discovery service. We structure and maintain your data according to best practices and apply the Get-Found Guarantee in §7. We do notcontrol any AI assistant's behavior and cannot guarantee that a specific assistant will name you (see §15).

5. Free AI Visibility Report & communications

You may request a free AI Visibility Report. The Report reflects point-in-time results from automated web-grounded model queries and is an estimate, not a guarantee of any outcome or a representation of a logged-in consumer app — AI answers vary by phrasing, location, and over time.

By giving us your email you agree we may send you your Report and related follow-ups. Marketing emails include a one-tap unsubscribe; transactional messages (e.g., booking and billing notices) continue as long as you have an account.

6. Subscriptions, billing & auto-renewal

Paid subscriptions are billed in advance to your payment method, monthly or annually per your selection, and auto-renew at the end of each period until you cancel. You authorize recurring charges for each renewal. An annual prepay option (discounted by roughly two months) may be offered; annual prepayments are non-refundable except as required by §7 or law.

Payments are processed by Creem, a Merchant of Record. Creem is the seller of record for the transaction and handles applicable sales tax/VAT; your payment contract for the charge is with the processor, while Booket provides the service. Prices are exclusive of taxes unless stated.

Cancel anytime, in one tap from your dashboard. Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again. No contracts, no cancellation fees. Except where §7 or law requires, fees already paid are non-refundable and cancelling does not refund the current period.

If a payment fails, we may retry via the processor; if it cannot be collected, your service may be suspended until resolved.

7. Get-Found Guarantee (“you don’t pay until you show up”)

We back AI Presence with this promise. The definitions in §2 make it fair to both sides — please read them.

The promise. If your business does not Show Up within 90 days of your Activation Date, your billing automatically pauses — you are not charged again until you do. We keep working on your AI presence at no additional cost during the pause. When we verify that you Show Up, billing resumes.

This is a keep-working / paused-billing guarantee, not a cash refund, unless we expressly offer a money-back guarantee in writing for your plan (in which case that written offer controls). The pause is your sole and exclusive remedy under this guarantee.

How we measure.We use current web-grounded models for recurring monitoring and record the model, query, time, and answer. These checks help us find opportunities but are not, by themselves, qualifying evidence. “Show Up” requires a separate check in the named consumer-facing ChatGPT, Gemini, or Perplexity product where the agreed service-and-area query names your business. We retain the query, surface, date, and answer excerpt. A specific rank, position, or wording is not required.

Your part. The guarantee applies only while you keep your information accurate and current; do not remove, override, or block the changes and listings Booket makes; maintain any required website or booking link; and respond to reasonable requests for input. Providing false information, removing our work, or being suspended by a Third-Party Platform voids the guarantee for that period.

What we don't promise.We do not guarantee rankings, position, traffic, bookings, revenue, that any specific assistant will recommend you, or results in any timeframe beyond the pause remedy above. The guarantee does not apply where your profile is incomplete, inaccurate, or not yet approved, or in a category or area where Booket's coverage is not yet active.

8. Neighborhood exclusivity (where offered)

Where we offer area exclusivity, we agree not to onboard a directly competing business in the same category within your Exclusive Zone while your subscription is active and in good standing. The radius is set by local density and recorded at onboarding.

Exclusivity is granted first-come, first-served. If a competing business has already claimed an overlapping Exclusive Zone, exclusivity may be unavailable and you may instead be offered a non-exclusive subscription. Any founding rate, where offered, is described at signup. Exclusivity ends when your subscription ends or lapses — at which point your zone is released and may be claimed by another business — and does not apply across different categories or outside your Exclusive Zone.

9. Your responsibilities

You are responsible for the business information you provide and for having the right to provide and publish it. You authorize Booket to act on your behalf for the integrations you enable (for example, Google Business Profile and your scheduler) and to publish your data across AI-readable surfaces. Keep your details accurate; out-of-date or conflicting information is the most common reason AI loses confidence in a listing.

10. Reviews

Where you enable review features, Booket helps you request genuinereviews from your real customers (e.g., a post-visit email or SMS link). You must solicit only honest reviews from actual customers, must not offer compensation or incentives in exchange for reviews, and must comply with each platform's policies and applicable law (including FTC guidance on endorsements). Booket never writes, buys, or fabricates reviews. You are responsible for any consent required to contact your customers.

11. Bookings

Where you enable booking-readiness, Booket facilitates a request or hand-off to your scheduler. Every AI-originated booking passes a human-confirm step (or an explicit auto-confirm rule you set). You confirm and honor appointments and own the customer relationship. Booket is not a party to, and is not responsible for, any appointment, no-show, payment, or dispute between you and your customers. Tracked links/numbers let us report clicks, calls, and bookings we drive; those figures are estimates, not a guarantee of revenue.

12. Messaging consent (email & SMS)

If you enable SMS (for booking confirmations or review requests), you confirm you have the recipients' consent to be contacted and that your use complies with applicable messaging laws. Message and data rates may apply; recipients can opt out by replying STOP and get help by replying HELP. You are responsible for the content you send through Booket.

13. “Found by AI” badge

If we issue you a “Found by AI” badge or Visibility Grade, we grant you a limited, revocable, non-exclusive license to display it while your subscription is active and your data is accurate. Don't alter it or use it in a misleading way; the license ends when your subscription ends.

14. Intellectual property & data

You retain ownership of your business data. You grant Booket a worldwide, non-exclusive license to use, store, adapt, and publish that data across AI-readable surfaces to provide the service. Booket retains all rights in its software, platform, and aggregated/anonymized analytics. We handle personal data as described in our Privacy Notice.

15. Third-party services

Booket depends on and integrates with Third-Party Platforms. Your use of those services is governed by their terms, and they may change, limit, or discontinue access at any time. Booket is not responsible for Third-Party Platform behavior, availability, or changes, including how any AI assistant ranks, describes, or omits your business.

16. Acceptable use

Don't use Booket to publish false, misleading, unlawful, or infringing information; to impersonate another business; to interfere with or abuse the service; or to violate any Third-Party Platform's rules. We may suspend or terminate accounts that do.

17. Disclaimers

Except for the Get-Found Guarantee in §7, Booket is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific result, ranking, traffic, or revenue.

18. Limitation of liability

To the fullest extent permitted by law, Booket will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Booket's total liability arising out of or relating to the service is limited to the amount you paid Booket in the 12 monthsbefore the event giving rise to the claim. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.

19. Indemnification

You agree to indemnify and hold Booket harmless from claims arising out of the information you provide, your use of the service, your dealings with your customers, or your violation of these Terms or any law or Third-Party Platform policy.

20. Termination

You may cancel anytime (§6). We may suspend or terminate the service for non-payment, violation of these Terms, or to comply with law. On termination, your subscription ends, your Exclusive Zone (if any) is released, and we will handle your data as described in the Privacy Notice. Sections that by their nature should survive (e.g., IP, disclaimers, liability, indemnification) survive termination.

21. Agencies & white-label

If you use Booket as an agency managing client locations, you represent that you are authorized to act for each client, you are responsible for your clients' compliance with these Terms, and you are responsible for amounts due for the locations under your account. White-label branding is licensed to you only for managing those locations on Booket.

22. Governing law & disputes

These Terms are governed by the laws of [jurisdiction — to be set with counsel; e.g., the State of Texas, USA, or the entity's home jurisdiction], without regard to conflict-of-laws rules. Disputes will be resolved in [courts of the chosen venue, or binding arbitration — to be decided with counsel]. Nothing here waives any non-waivable consumer right.

23. Changes to these terms

We may update these Terms. If we make material changes we'll notify you by email or in your dashboard and update the version above; material changes that affect a live subscription take effect on your next renewal or, where required, on your re-acceptance. Continued use after notice constitutes acceptance.

24. Miscellaneous

These Terms (with the Privacy Notice and any plan terms shown at signup) are the entire agreement between us. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
